Terms of Service

These Terms of Service ("Terms") govern your use of the GymMaxx mobile application ("the App") provided by your gym ("the Gym", "we", "us"). By using the App, you agree to these Terms.

1. Account Creation

Accounts are created by your gym's reception staff when you register as a member. You activate your account by entering your email address in the App and setting a password ("Claim Account"). You are responsible for maintaining the confidentiality of your password and for all activities under your account.

2. Gym Membership

The App is a companion tool for your gym membership. Use of the App requires an active membership with a participating gym. Subscription plans, pricing, and access rules are determined by your gym and may change with notice.

3. NFC Card Usage

Your gym may issue you a physical NFC card for check-in and check-out at the facility. You are responsible for your card's safekeeping. Report lost or damaged cards to your gym's reception immediately. The gym may charge a replacement fee as determined by their policy.

4. Acceptable Use

You agree to:

• Provide accurate personal information
• Use the App only for its intended purpose (managing your gym membership and fitness activities)
• Not share your account credentials with others
• Not attempt to access other members' data or circumvent security measures
• Not use the App for any unlawful purpose

5. Workout Plans

The App may generate personalized workout plans based on your fitness preferences. These plans are for informational purposes only and do not constitute medical or professional fitness advice. Always consult a qualified fitness professional or physician before starting a new exercise program, especially if you have pre-existing health conditions.

6. Class Bookings

Class availability and capacity are managed by your gym. Bookings are subject to availability and may be cancelled by the gym with reasonable notice. Cancellation policies are determined by your gym.

7. Subscriptions and Payments

Subscription management and payments are handled by your gym directly. The App displays your subscription status but does not process payments. For billing inquiries, contact your gym's reception.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. You have the right to export or delete your data at any time through the App.

9. Intellectual Property

The App, its design, code, and content are the property of GymMaxx and its licensors. Your gym holds a license to operate the App for its members. You may not copy, modify, distribute, or reverse-engineer any part of the App.

10. Limitation of Liability

The App is provided "as is" without warranties of any kind, express or implied. We are not liable for:

• Injuries sustained during workouts (follow plans at your own risk)
• Service interruptions due to maintenance, network issues, or force majeure
• Loss of data beyond what is described in our data retention policy
• Actions taken by your gym regarding your membership

To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for your gym membership in the preceding 12 months.

11. Termination

Your gym may terminate your access to the App if your membership is cancelled or if you violate these Terms. You may delete your account at any time through the App. Upon termination, your data will be handled according to our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes via in-app notification.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which your gym operates. Any disputes shall be resolved in the courts of that jurisdiction.
